The Department of Employment and Labour has released the new earnings threshold. This earning threshold is now R241 110.59 per annum.
As you will know, anyone earning more than the above amount is exempt from the application of various section of the Basic Conditions of Employment Act. The Gazette goes further to define earnings as the regular annual remuneration before deductions i.e. income tax, pension, medical and similar payments but excluding similar payments (contributions) made by the employer in respect of the employee: Provided that subsistence and transport allowances received, achievement awards and payment for overtime worked shall not be regarded as remuneration for the purpose of this notice.
